Trade in Endangered Species Act 1989 (No. 18 of 1989).

This Act provides for the management, conservation and protection of endangered, threatened, and exploited species. The Act consists of 5 Parts divided into 55 sections, and of 3 Schedules.
The Minister shall establish a Scientific Authorities Committee as provided for in section 7. The Director-General shall grant permits and certificates for the trade, export and import of endangered, threatened, and exploited species as provided for in Part I. A permit or certificate shall authorise the holder to undertake on one occasion the type of trade specified in that permit or certificate, and it shall remain in force for a period of 6 months. Section 28 deals with the disposal and release of specimens seized from arrivals from overseas. Provisions of Part I shall not apply in the following cases: specimens of an endangered, threatened, or exploited species that are a personal or household effect; non-commercial loans, donations, or exchange between scientists or scientific institutions in New Zealand recognised by the Director-General of specimens of an endangered, threatened, or exploited species, etc. (Part II). Every Inspector and every officer of customs shall be an Endangered Species Officer for the purposes of this Act (Part III). Powers and duties of Endangered Species Officer are specified in sections 37 and 38. The seizure of endangered species traded in contravention of Act, and the custody, release and disposal of seized specimens are provided for in sections 39-43. Part III contains penal provisions and provisions of miscellaneous nature.
